Pursuant to WIC 631 (c), whenever a minor who has been held in custody for more than 24 hours by the Probation Officer is subsequently released and no petition is filed, the Probation Officer shall prepare a written explanation of why the minor was held in custody for more than 24 hours. The written explanation shall be prepared within 72 hours after the minor is released from custody and be filed in the record of the case. A copy of the written explanation shall be sent or personally delivered to the parents, guardians or other person having care or custody of the minor.

APPLICABILITY: For any case under the age of 18.

When a Deputy Probation Officer (DPO) or Supervising Deputy Probation Officer (SDPO) releases a minor who has been detained for more than 24 hours without filing a petition, the DPO/SDPO shall do the following:

  1. Complete the WIC 631 (c) letter located in monitor.
  2. The letter shall be delivered in person or by mail to the parent(s)/legal guardian(s) (If parents live separately, a letter will be sent/delivered to each parent) within 72 hours of release.
  3. Print and save a copy in Monitor of the letter(s) and give to Administrative Assistant III for mailing, if not personally delivering the letter.
  4. Complete a journal note in Monitor indicating a letter has been completed and mailed or personally delivered.
