Appeal a Road Improvement Fee

What is the process?

Submit Appeal

The appeal shall be made in writing and filed with the Clerk of the Board of Supervisors, together with any required appeal fee not later than (10) ten days prior to the public hearing on the permit application for the new development project; or in the case of applications for plot plans, site plans or building permits, at the time of making application.

The appeal shall state in detail the factual basis for the claim of waiver, reduction, or adjustment.
 

Receive Hearing Notice

You will receive written notification of your scheduled hearing.

Pursuant to County Code Section 13.01.050, the Clerk of the Board of Supervisors will schedule your appeal for a public hearing before the County Board of Supervisors no later than sixty (60) days after the filing of the appeal.

Board of Supervisors Hearing

The decision of the Board of Supervisors on the appeal shall be final. If a reduction, adjustment or waiver of the fee is granted, any change in permitted type or intensity of land use within the approved new development project shall invalidate the waiver, adjustment, or reduction of the fee.

Is there a charge for this service?

Please refer to the Department of Public Works Fee Schedule. Road improvement appeal fees are non-refundable unless the Board of Supervisors waives the fees at the hearing upon consideration of the appeal.

When and where is this service offered?

This service is available anytime throughout the year at the Administrative Office in San Luis Obispo during regular business hours except during County-observed holidays.
