County Real Property Purchase of Real Property
Real Property Services (RPS) represents County departments in real estate negotiations for the purchase of land and/or developed real property for use by the County. Purchase transactions are subject to the approval by the Board of Supervisors.
Past projects have included:
- 37 acres in the unincorporated area of Avila for use as open space and/or passive recreation.
- Vacant land for a fire station in northern San Luis Obispo County.
- Property acquisition for the expansion of the San Luis Obispo County Regional Airport.
What is the process?
Identify Property
RPS works with County departments to identify needs and locate real property.
Board of Supervisors Review
RPS will take item(s) to the Board of Supervisors in Closed Session and ask for direction.
Appraisal
Upon direction from the Board of Supervisors, RPS will order an appraisal of the subject parcel.
Commence Negotiations
RPS will commence negotiations with the property owner and obtain a signed Purchase Agreement, which is subject to the approval of the Board of Supervisors.
Obtain necessary reports and determinations
Once the County and landowner have a signed Purchase Agreement, RPS will request reports and environmental determinations from the appropriate County or City Planning department.
Resolution of Intent to Purchase
When all documentation is received, RPS will place a Resolution of Intent to Purchase on the consent agenda at the next available Board of Supervisors' meeting. Upon Board approval, the Resolution will be published in a newspaper of general circulation once a week for at least three (3) weeks. The notice indicates the location of the property and the date and time at which the Board of Supervisors intends to take action regarding the purchase.
Resolution Authorizing the Purchase
Once the Resolution of Intent to Purchase is approved and published, RPS will place a Resolution Authorizing the Purchase on the consent agenda of the earliest possible Board of Supervisors meeting. The Board packet will include the signed Purchase Agreement, which describes all of the terms and conditions of the purchase.
Complete Transaction
Upon approval, the Board will direct the County Property Manager to open escrow and to submit and execute all necessary documents to close escrow according to the terms and conditions of the Purchase Agreement.

RPS negotiates with owners of private property located within the County of San Luis Obispo as needed to acquire property for County use.

FAQS
Timelines can vary depending upon the terms of the Purchase Agreement and the actions of third parties. Once RPS has received the signed Purchase Agreement and all reports, the time between the Resolution of Intent and the Resolution Authorizing the Purchase typically takes 4-5 weeks. Escrows can take 45 (or more) days after the Resolution Authorizing the Purchase has been approved.
