Cannabis Dispensaries
Limitation on Use:
- Cannabis dispensaries not operating within a permanent structure are prohibited.
- Cannabis dispensaries shall not include storefronts nor otherwise be open to the public for retail sales. Only dispensaries requiring a Type 9 Non-Storefront Retailer State license are allowed. Dispensaries requiring a Type 10 Retailer State license are prohibited.
- Cannabis dispensaries within a permanent structure that do not include a storefront and are not open to the public for retail sales (mobile deliveries only) may be permitted in the Agriculture (AG) or Commercial Service (CS) land use categories within an Urban Reserve Line (URL) only, and may be permitted in the Industrial (IND), Residential Rural (RR), and Rural Lands (RL) land use categories subject to a land use permit.
- Cannabis dispensaries in the Residential Rural (RR) and Residential Lands (RL) land use categories are limited to the dispensing of cannabis that is grown on site.
- Cannabis dispensaries in the Agriculture (AG) land use category are limited to the dispensing of cannabis that is grown on site, or cannabis products manufactured with cannabis grown on site.
Land Use Permit Required. Standalone dispensaries in Commercial Service (CS) or Industrial (IND) land use categories require Minor Use Permit approval. Vertically integrated dispensaries in Agriculture (AG), Rural Lands (RL), or Residential Rural (RR) land use categories require Conditional Use Permit approval.
