Former Cal Poly student Resident Advisor sentenced to 7 years 4 months in prison for sexual assault at Cal Poly student dormitory

District Attorney Dan Dow announced today that Alexis Alejandro (DOB 01/07/1999) was sentenced to 7 years 4 months in state prison for his guilty plea to Assault with Intent to Commit a Sex Offense and First-Degree Residential Burglary. He is also ordered to register as a sex offender for his lifetime.


During his guilty plea, Alejandro also admitted three factors in aggravation; (1) that the victim of his crimes was particularly vulnerable, (2) that the manner in which the crimes were committed indicates planning, sophistication, or professionalism, and (3) that he exploited a position of trust or confidence to commit the crimes. Factors in aggravation are used by a sentencing Judge to support a greater sentence.  Both crimes are “strikes” under California’s Three Strikes Law.

The assault occurred in a dormitory on the Cal Poly San Luis Obispo campus at about 3 a.m. on September 7, 2024, when a female student awoke to find then-Resident Advisor Alexis Alejandro inside of her darkened dorm room without her permission.  The victim screamed and Alejandro placed his hand on her face, in an apparent attempt to keep her quiet. 

Alejandro fled and was not immediately identified.  However, the Cal Poly University Police Department quickly established that Alejandro had accessed the survivor’s dorm room using a master key accessible to Cal Poly Resident Advisors

The survivor provided a written victim impact statement that was read at sentencing.  In it she wrote, “I have recovered from the bruises that were caused by the physical struggle with [Alejandro], but there are still things I struggle with every day” and described how the assault continues to profoundly affect her day to day life and that of her family and friends.  

 “Our college campuses should be a place of safety for all who live there, not a place where students live in fear of being assaulted,” said District Attorney Dan Dow. “The traumatic impact of the defendant’s predatory crime on this college student victim was horrific and inexcusable – well deserving of this prison sentence.”

During her comments at the sentencing hearing, Deputy District Attorney Kristin Barnard described the crime and its aftermath, noting that “while [the survivor] may never forget the night of September 7, 2024, when Alexis Alejandro broke into her apartment…she will move forward from this and she will go on to lead a happy and fulfilling life.”  Mrs. Barnard closed by acknowledging the victim’s courage, strength, and resilience throughout the process.  

The case was investigated by the Cal Poly University Police Department with the assistance of the District Attorney’s Office Bureau of Investigation and was prosecuted by Deputy District Attorney Kristin Barnard assigned to the Sex Crimes Prosecution Unit.  Victim services were provided by Victim Advocate Divina Diaz.

The survivor is referred to as Confidential Victim in court documents to maintain her confidentiality and privacy.
