4.10 Home Supervision/Electronic Monitoring

Purpose The purpose of this procedure is to establish guidelines for supervising a youth who is placed on home supervision, with or without electronic monitoring, in compliance with WIC 628.1 and WIC 841.

APPLICABILITY:

  1. This procedure applies to Deputy Probation Officers supervising a youth who is released on home supervision, with or without electronic monitoring (EM), in lieu of remaining in secure detention.
  1. Any youth who meets one or more of the criteria for detention, but does not require 24-hour secure detention, shall be released on home supervision pursuant to Section 628.1 of the Welfare and Institution Code or by court order pursuant to Section 636(b) of the Welfare and Institution Code.
  1. Any youth placed on EM shall receive custody credit for each day served on EM pursuant to WIC 628.2(c). 
  1.  If EM is imposed for a period greater than thirty (30) days, the DPO shall ensure/request a progress hearing is scheduled within thirty (30) days of the initial order for EM pursuant to WIC 628.2(d).
  1. Any youth who has an assigned DPO will be supervised by the assigned DPO while on home supervision.
  1. Any youth who does not have an assigned DPO will be supervised by the home supervision DPO.

GENERAL PROCEDURE:

  1. Court orders and home supervision agreement
    1. Following a detention hearing, releases on home supervision shall be determined by an order of the Court.  Search/seizure and chemical testing terms shall be ordered by the Court and added to the home supervision agreement.
    2. A youth may be released on home supervision prior to a detention hearing with approval of a supervisor.
    3. As a condition of home supervision release, the minor shall be required to sign a written promise that he or she understands and will comply with the specific conditions of the home supervision agreement.  This document is found in Monitor.
    4. When a youth is placed on EM an enrollment will be opened in Monitor per the enrollment procedure.
    5. The assigned DPO shall update the custody aggregation sheet with the credits for time served on EM.
  2. Set up: Home Supervision
    1. Obtain court order reflecting the youth is ordered released on home supervision with or without electronic monitoring.
    2. Collaborate with Juvenile Hall to determine the best time to release youth from custody.
    3. Complete home supervision agreement in Monitor with appropriate conditions and special instructions.
    4. Confirm with parent/guardian who lives in the home whether there are any weapons (secured or unsecure), dogs or other potential safety issues (such as other probationers residing in the home, etc...)
    5. Once the agreement has been reviewed and signed by the youth and parent(s)/legal guardian(s) the agreement shall be saved in Monitor and distributed to Court, DA, Counsel for the minor, youth, and parent(s)/legal guardian(s).
  3. Set up: Electronic Monitoring
    1. Obtain an EM unit. Go to the Track Group website, (https://intellitrack.trackgrp.com/auth/login).
    2. Follow the directions in the IntelliTrack Agency Quick User Guide v1.2 located in the F: Drive/Juvenile Division/Court Folder to set up an offender.
  4. Supervision
    1. Deputy Probation Officer (DPO) assigned to home supervision program shall carry a caseload of no more than 10 youth; if EM is utilized, the caseload shall be no more than 15.  (WIC 841).
    2. DPO shall monitor all youth on home supervision with or without EM.  If youth is on probation, DPO will work in collaboration with assigned field deputy.
    3. DPO shall communicate with youth and parent/guardian and confirm awareness of future court hearing(s) and interviews with investigation deputy. 
    4. DPO should conduct face-to-face contacts with youth a minimum of 2 times a week, and 1 face-to-face contact with parent/guardian.
  5. Violations
    1. If a youth violates the conditions of release, the youth may be taken into custody in compliance with WIC 628.1 and the department’s arrest policy.
    2. Process detention in compliance with detention worksheet guidelines.
    3. Write and submit a home supervision violation memorandum.
  6. After Hours Calls
    1. All calls will be directed to 781-5352, resulting in a default to 781-5389 during non-business hours.
    2. When a call is received, the youth’s DPO will be verified in Monitor.  All Home Supervision Contracts can be found in Monitor under “documents” to confirm conditions of the contract. 
    3. If there are special instructions for after hour calls, resulting in a request for a youth to be brought into custody, an email will be sent to PR_JSOIII and PR_JH_Control with details regarding the circumstances.  Included will be the end date of the youth’s EM.
    4. If EXCLUSION zones are set, an email will be sent to PR_JSOIII and PR_JH_Control with details regarding specifics of the zones.  (e.g. victim residence).  Included will be the end date of the youth’s EM.
    5. All calls will result in an email to the assigned deputy, and or the deputy assigned to Home Supervision, and the Juvenile Supervisors (PR_JUV_JSC_SDPO) regarding the nature of the call.
    6. All calls reporting a youth is in their EXCLUSION ZONE will result in local law enforcement being immediately notified with a request the youth be brought into custody for the violation.
  7. Removal of EM devices
    1. Upon removal, officer shall ensure all equipment is returned in proper working condition.
    2. Log on to IntelliTrack and deactivate and archive the E.M. Once device is “deactivated”, remove the device off the youth with proper removal tool.
    3. Close the enrollment in Monitor effective the date the device was removed.
    4. Return the EM device to the EM storage desk for charging.
    5. If an EM device needs to be removed on a weekend or holiday, prior arrangements will be made with Juvenile Hall by contacting the JSO III on duty.

EXCLUSIVITY:

This procedure will remain in effect until superseded or suspended in writing and can be reviewed as needed.
