4.18 PC 296 Specimen Collection

Subject 4.18 PC 296 Specimen Collection
Purpose Establish a procedure for the tracking and collection of PC 296 specimens from juvenile offenders.

PC 296 requires any juvenile who is adjudicated under WIC 602 for committing any felony offense to provide buccal swab samples, right thumbprint for inclusion in the State Forensic Identification Data Base.

General Procedure:

The assigned Deputy Probation Officer (DPO) is responsible for making sure that PC 296 specimens are collected on any case under their supervision that fall under this requirement.  

Specific Procedure:

  1. The Juvenile Division Legal Clerks (LCs) will create a “DNANeeded” flag in Monitor at the time they process any court order for PC 296 submittal.
  2. As soon after the court order as possible, the assigned DPO will collect the specimen himself/herself or make arrangements for another DPO or Juvenile Services Officer (JSO) to collect the specimen.  Either way, it will be the assigned DPOs responsibility ensure the following:
    • PC 296 collection verification form completed (form & file to Legal Clerk for processing after specimen collected)
    • DNA Specimen Information Card-Rev 5 is completed and signed.
    • Specimen is placed in Transport Pouch and sent with Specimen Identification Card to the Department of Justice State Forensic Identification Data Base in a sealed pre-addressed return envelope.
  3. Upon collection and mailing of the sample, the DPO will submit the PC 296 collection form and case file to a Legal Clerk to complete the following:
    • Enter PC 296 collection verification form into file narrative
    • Deactivate “DNANeeded” client flag
    • Activate “DNATested” client flag
    • Create a journal note designating DNA has been collected and collection verification form entered into file narrative
