Judge Sentences Man to State Prison for Sex Offense Against Intoxicated Victim

David E. Ardebili has been sentenced to 4 years and 6 months in state prison for his conviction of Attempted Sexual Penetration of an Intoxicated Victim as a felony and simple assault. The predatory crime occurred June 18, 2017 after Ardebili enticed the victim, who he did not know, to enter his vehicle before sexually assaulting her at the Atascadero Lake Park.


District Attorney Dan Dow announced today that David Ebrahimi Ardebili (DOB 07/31/1978) has been sentenced to 4 years and 6 months in state prison for his conviction of Attempted Sexual Penetration of an Intoxicated Victim as a felony, and simple assault as a misdemeanor. 

On May 17, 2019, a San Luis Obispo County jury found Ardebili guilty of both offenses.  These crimes were committed against a female victim during the early morning hours of Sunday, June 18, 2017, in Atascadero Lake Park.

During the previous evening of June 17, 2017, the female victim had separated from friends and family in downtown San Luis Obispo while visiting from out of the area.  The evidence eastablished that the defendant had observed the highly intoxicated victim walking alone and that he enticed her into his vehicle before he drove her to a secluded parking area at the Atascadero Lake Park.  Evidence collected by law enforcement supporting the sexual assault crimes included Ardebili’s DNA that was found on the victim’s underwear.

Ardebili was tried and sentenced in Department 8 of the San Luis Obispo Superior Court, the Honorable Judge Matthew Guerrero presiding.

Under California law (Penal Code section 667.5(c)), this sexual assault offense is not defined as "violent" and therefore defendant is eligible to seek early release on parole pursuant to Proposition 57 that California Voter's passed in 2016.

This case was investigated by the Atascadero Police Department with the assistance of the District Attorney's Office Bureau of Investigation.   Deputy District Attorney Lisa Muscari who is assigned to the Sexual Assault Prosecution Unit prosecuted the case.
