I. Authority
This policy is issued under authority granted to the Chief Probation Officer.
II. Purpose
The purpose of this policy is to address the requirements of the Fair Labor Standards Act (FLSA) as it relates to overtime and the Department’s implementation of those requirements.
III. Applicability
This applies to all staff that are not in a management bargaining unit.
IV. Background
The provisions of the FLSA cover all non-management employees. At times departmental needs require staff to work in excess of 40 hours/week.
V. General Policy
- There can be no informal accumulation and recording of compensatory time. Any and all overtime worked must be recorded on the timecard each week.
- Non-management staff are scheduled to work a 40-hour week. Any work in excess of 40 hours in a week is considered overtime and must be recorded and compensation provided.
- No staff shall work overtime without prior permission of their Chief Deputy, following consultation with their supervisor. In the event you are unable to reach your Supervisor and/or Chief Deputy, the chain or command shall be utilized.
VI. Exclusivity
This policy will remain in effect until superseded or suspended in writing by the Chief Probation Officer and can be reviewed as needed.
