Purpose This duty is to be performed by the Deputy Probation Officer (DPO) assigned to the County Jail working in the Jail Programs Unit to assist the Sheriff's Department with the responsibilities of PC1170

  1. The assigned DPO will receive a resentencing request packet from the Undersheriff/Sheriff to review on a defendant requesting resentencing on their case pursuant to PC1170(d)(1).
  2. The DPO will interview this defendant with questions including the following.
    1.  What plan does the defendant have when released from custody?
    2. Does defendant have a residence in which to reside?
    3. Does defendant have a job, school, etc. upon release?
    4. Does defendant have any counseling plans, to include a residential or sober living environment?
    5. Has this defendant been active in counseling/programs while in custody?
    6. Does defendant have a plan on how they will be successful in the community and what does it entail?
    7.  Are there any changes defendant will make in their life to help them be successful?
    8. Will transportation be an issue that will hinder their success?
  3. Once the DPO has completed their investigation, the DPO will write a memo and submit it along with the request packet to the Undersheriff/Sheriff's office.
    1. The memo will include a summary of the interview and a recommendation.
