1.20 Bag and Baggage release of probationer from jail to a residential treatment program, sober living program or to another location per court order and upon release.

Purpose The procedure to address arrangements made for Bag and Baggage (B&B) releases to Probation.

Once plans for the transportation of a probationer from the jail to a residential/sober living program or to another location as directed by the Court, have been confirmed, the following shall be completed.

  1. If a Deputy Probation Officer has been granted discretion to release a probationer  early from custody by the Court and would like to schedule a B&B, the officer shall ensure that any cases in which the probationer was remanded to the Sheriff’s Department to serve a term of incarceration have been satisfactorily met. If the Deputy Probation Officer assigned to the Jail Programs Unit is out for an extended period, the assigned Supervisor to the officer shall take primary role of scheduling B&B’s.
  2. Call or email the Deputy Probation Officer assigned to the Jail Programs Unit and confirm the release date.
  3. Request the probationer be placed on Bag & Baggage (B&B) by providing the following information:
    1. Name of probationer.
    2. Date and time of B&B.
    3. Agency to pick up or person (relationship) to probationer.
    4. Name of person picking up.
    5. Contact number of persons picking up.
  4. The Deputy Probation Officer assigned to the Jail Programs Unit will contact the Sheriff’s Department Correctional Technician who will complete notification paperwork and route to Classification & Booking that probationer can’t be release until specified date and time as outlined in the B&B paperwork. The B&B’s shall not be scheduled during lock down hours,0400, 1100,1600, and 2300 hours.
  5. It is preferred B&B not be scheduled during the hours of shift change: 0600-0700 and 1800-1900. 
  6.  If a DPO is picking up the probationer, the DPO will call extension 4601 or 4602, thirty (30) minutes prior to pick up.
  7. By following this procedure, this will prevent early release passes for probationers going into a residential/sober living program. Be aware that Classification prepares Sheriff’s Passes on Sunday, Tuesday, and Thursday for releases to take place on Monday, Tuesday and Friday.  Early releases are calculated and prepared daily by Classifications.

B & B Release Procedure to another agency- Updated 8/1/18

Purpose:  This procedure serves as a guide to address arrangements made for B&B releases to Probation and other agencies for delivery to outside treatment. The goal of this procedure is to provide adequate time for agencies to collaborate on transfer of inmates from custody to Sober Living Environments (SLE) under realignment guidelines, while meeting the legal obligations we have under the courts and reducing liability for the Sheriff’s Office.

If instructions are written on the minute order: (Examples: “Defendant to be released to Probation or designee” or “Discretion for early release given to Probation or designee”)

  1. Follow the court order and honor a B&B release.  This can occur at any time of day (even after 1100). 
  2. If the inmate has a ride show up at midnight do not release the inmate to the street.  Honor the B&B and follow the court order. 
  3. In the case of Pass releases for crowding when there is a B&B set up, make contact with the receiving agency prior to a pass release being approved. Attempts will be made to honor the B&B.

 

No instructions are written on the minute order:

  1. The Sheriff's Office will honor a B&B release until 1100-hour count on the release date.  B&B’s set-up after 1100 or if the agency fails to arrive prior to 1100 the inmate will be released to the street. 
  2. The Sheriff's Office may approve a PASS for an inmate to be picked up with a B&B for delivery to another location (ie. Probation). This will be allowed no more than one day prior to the scheduled release date, not including weekends.
  3. If the inmate has a ride show up at midnight and a B&B is set-up do not release the inmate to the street. 
  4. If the inmate has a ride show up at midnight and a B&B is not set-up release the inmate to the street.

Any portion of a day is a day. We are not legally mandated to release someone at 0001 hours even if they have a ride. Under realignment we have an obligation to collaborate with other agencies to turn someone over for safe transport to other treatment providers when it is in the best interest of the inmate.  This will reduce our liability and hopefully keep them out of jail long-term.

Exceptions: There may be sensitive cases/ individuals that need special consideration such as the case with any of our medically fragile or mentally ill (these will be less common).   Correctional Sergeant or JPU Sergeant discretion, in consultation with the Chief Medical Officer, prior to release date will be used in these cases. Open communication with the receiving agency, such as Probation, Drug and Alcohol or Forensic Reentry Services, will also be required to prevent unnecessary work or wasted services.
