Purpose Standing Court by the Superior Court of the State of California in and for the County of San Luis Obispo, dated July 23, 2012, authorizes the Probation Department to release adult probation records

Probation Reports and Records

  1. Adult Probation records and reports should only be release to peace officers of the State of California as defined in Penal Code Sections 830.1, 830.2(a) and (d), 830.3(e), and 830.5(a) and (b); peace officers as defined by applicable laws of the United States or other states; and Judges or other judicial officers of all United States federal courts and all courts of states, territories or possessions of the United States.
  2. All records request by a “requesting agency” shall be a written request on agency identifiable letterhead, stating the request is for the purposes of conducting criminal, pre- or post-sentence, or pre-trial investigations.
  3. No medical, mental health or drug and alcohol treatment record shall be released to a requesting agency except as contained in probation reports or terms and conditions of probation.
  4. Probation staff in receipt of a request for adult probation records or reports shall route the request and reports to be provided to their immediate supervisor or the Chief Deputy for review and approval to release.
  5. Supervisors or the Chief Deputy shall review all records and reports and remove or redact all identifying information concerning any person except the subject of the report or record and/or any public official therein prior to providing documents to the requesting agency. The supervisor or Chief Deputy will sign and date the request indicating approval to release.
  6. Once a probation record or report is released, the written request from the requesting agency will be placed in the Probation file along with a copy of the probation record(s) or report(s) provided.
