13.2 Home Supervision

- The Probation Department shall operate and maintain a Home Supervision program for youth described in Section 628.1 of the Welfare and Institutions Code pursuant to Section 840.
- A youth who meets one or more of the criteria for detention, but does not require 24 hour secure detention, may be released on Home Supervision pursuant to Section 628.1 of the Welfare and Institutions Code or by court order pursuant to Section 636(b) of the Welfare and Institutions Code.
- The Home Supervision Program and its officers shall be under the supervision of the Chief Deputy Probation Officer of the Juvenile Services Division or their designee and adhere to the statutory requirements pursuant to Section 841 of the Welfare and Institutions Code.
- Supervision of Youth:
- The Court or Probation Officer may impose curfew times, school attendance requirements, electronic monitoring or any other special conditions necessary to assure the protection of the youth and community and their further appearance in Court.
- No search of the youth’s person or property or chemical testing can be conducted unless specified by court order. (The court order for HS is not specific to terms of release.)
- Enforcement of Home Supervision release conditions shall be conducted under established Probation Department policies.
